  • We do have science on our side, and that is why leading expert health regulators worldwide who consider the full body of science have consistently concluded that glyphosate-based herbicides are safe when used as directed and that glyphosate is not carcinogenic, in contrast to the decisions reached by juries.
  • The problem is that juries in all of the trial settings to date have been presented with a very narrow slice of the science by plaintiffs' lawyers, and much of it is not reliable because of small samples or studies confounded by exposure to other chemicals. This is unlikely to change under the evidentiary rulings by trial courts to date and is emblematic of the types of difficulties faced by defendants dealing with medical causation issues under the U.S. mass tort legal system.
  • By excluding the appeals from the settlements, our hope is that appellate courts will reverse the verdicts in the trials to date based on several grounds, including that there is not sufficient evidence of causation based on the weight of the scientific studies and consistent positive assessments by regulators in the U.S. and worldwide.
  • And, under the class settlement, any future potential litigation by class members will be subject to the findings of the independent Class Science Panel on whether RoundupTM can cause NHL, and if so, at what minimum exposure levels, which, for purposes of the class, takes this important scientific determination out of the jury trial setting and puts it back in the hands of experts.
  • We are also settling because had we continued to litigate, we could have faced upwards of 20 trials in a year in multiple venues, the steep defense costs, media coverage and confusion that comes with them, and plaintiff numbers that can grow in size year after year as a result of aggressive plaintiff advertising.
